By accessing or using Tyler's Track ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Tyler's Track provides a platform for brands to collect real-time product sentiment and feedback from shoppers through QR code-based interactions. The Service includes dashboard analytics, micro-survey tools, and community building features for FMCG brands.

3. User Accounts

For Brands: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account.

For Shoppers: Participation is voluntary. You may choose to provide feedback anonymously or opt-in to join brand communities with your explicit consent.

4. Data Collection and Use

By using the Service, you acknowledge that:

  • Brands receive aggregated, anonymized sentiment data by default
  • Shoppers control whether to share personal information with brands
  • All data collection complies with New Zealand Privacy Act 2020 and applicable regulations
  • Personal data is only shared with explicit user consent

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Submit false, misleading, or fraudulent information
  • Harass, abuse, or harm other users
  • Scrape, crawl, or systematically collect data without permission

6. Intellectual Property

The Service, including all content, features, and functionality, is owned by Tyler's Track and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

7. Payment Terms (for Brand Partners)

Brand partners agree to pay fees as outlined in their subscription plan. Fees are non-refundable except as required by law. We reserve the right to modify pricing with 30 days' notice.

8. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may terminate your account at any time by contacting us at [email protected].

9. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranties of any kind, either express or implied. Tyler's Track shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New Zealand. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of New Zealand.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
